Customer:
The person or legal entity on whose behalf an agreement was made with Provider to provide a Service.
User:
Any person using the Service provided by Provider to Customer, either with or without Customer's consent.
Abuse:
This includes but is not limited to:
Any criminal activities, as defined by the law of:
Customer's country of residence (natural persons) or company registration,
Mass sending of unsollicted e-mail (SPAM).
Sending floods of any kind to any other computer system or network which inhibits the correct behaviour of said computer system or network.
Harrassment of individuals.
Endangering the quality of service or network stability for other internet users in any way.
Agreement:
Customer agrees to warrant Provider from any legal and/or financial claims, caused by or as a result of any User of his Service their actions, including his own.
Customer accepts full responsibility and liability for all actions involving the use and/or Abuse of the Service by any User, and liability for all damages caused by such.
Customer agrees make sure no Abuse takes place using the Service provided to Customer.
Provider reserves the right to discontinue the Service, in case of breach of the CB3ROB Ltd. & Co. KG Service Agreement.
Customer can terminate the Service by e-mail or letter at one month's notice.
Provider reserves the right to make changes to the Service specification or availability at any time.
Provider agrees not to provide personal details supplied by the Customer to third parties, unless required by law.
Provider will attempt to provide the best quality of service possible.
Customer agrees to be invoiced by e-mail and/or letter and pay within 14 days after issue date.
Provider has the right to update the CB3ROB Ltd. & Co. KG Service Agreement at any time, within the limits defined by applicable law.
Provider reserves the right to refuse to engage in a business relationship with specific potential Customers.
In case one or more paragraphs of the CB3ROB Ltd. & Co. KG Service Agreement, at any time, become illegal, the remainder of them stay in effect.
Specific terms and conditions can apply in addition to the CB3ROB Ltd. & Co. KG Service Agreement to specific Customers or Services.
By engaging in a contractual or (legally-binding) payment relationship with Provider, the customer agrees to the CB3ROB Ltd. & Co. KG Service Agreement and future versions thereof.
The law of the Federal Republic of Germany is applicable to the Service provided by Provider to the Customer.
This does not imply German law also applies to Services provided by the Customer to third parties, using the Service.
The court of Berlin, Germany shall be accepted by the Customer as the Authority to handle all disputes between Customer and Provider regarding the provided Service.
